These Terms and Conditions of Sale are valid between Napu Puhkemaja OÜ (registration code 17214122, hereinafter referred to as the “Provider”) and the client (hereinafter referred to as the “Client”) when the Client books and pays for the accommodation service on the Provider’s website. www.napupuhkemaja.ee. By making a booking, the Client confirms that he has read, understood and agrees to be bound by these Terms and Conditions of Sale.
1.1. The booking will only be deemed confirmed if the Customer has paid the full amount of the booking via the website. In the event of non-confirmation, the booking shall be deemed void.
1.2. The customer is responsible for the accuracy of the information provided at the time of booking.
2.1. Confirmed reservations cannot be cancelled and are non-refundable, unless the reservation is cancelled by the Supplier on the grounds set out in clause 6.
3.1. Check-in is booked from 15.00 on the day of arrival.
3.2. Check-out must take place no later than 12.00 on the last day booked.
4.1. Smoking is not allowed in the holiday home. The Offeror is entitled to a contractual fine of EUR 100 for non-compliance with the smoking ban.
4.2. The maximum number of guests is 3. Exceeding this limit is prohibited.
4.3. If the number of guests exceeds the agreed number of guests or the maximum capacity of the holiday home, the Provider has the right to refuse to hand over the holiday home. In such a case, the advance payments will not be refunded.
4.4. The customer undertakes to keep the holiday home and the property contained therein in good condition.
4.5. The Customer shall fully compensate for all damages (including breakage, vandalism, physical damage to other persons, etc.).
4.6. The Customer is obliged to inform the Supplier immediately if anything is damaged or broken in the holiday home or its furnishings.
5.1. In exceptional circumstances, the Supplier reserves the right to cancel the reservation by informing the Client within a reasonable time before the start of the accommodation. In this case, the Customer will be refunded the full amount paid.
5.2. The Supplier also has the right to cancel the reservation if the Customer breaches these Terms and Conditions of Sale prior to the commencement of the accommodation or if other circumstances arise which make the provision of the accommodation service impossible (e.g. force majeure).
6.1. All persons staying at the holiday home are the full responsibility of the person making the reservation. The Reserver undertakes to ensure that all guests comply with these Terms and Conditions of Sale and with the internal rules of the Holiday Home.
6.2 The Provider shall not be liable for any damage, accidents, injury or other incidents caused by the guests during the use of the holiday home, unless the damage is caused by the Provider’s intentional action or gross negligence.
6.3 The Provider shall not be liable for any loss of income, loss of holiday, loss of accommodation or any other indirect or direct loss or damage which may arise from the non-availability of the service, non-use of the service or cancellation of the reservation for any reason whatsoever.
7.1. The processing of customers’ personal data is carried out in accordance with the applicable data protection legislation and is described separately in the Privacy Policy.
8.1. The law of the Republic of Estonia shall apply to the terms of sale.
8.2. In the event of a dispute, the parties are obliged to first try to resolve the dispute by negotiation. If no agreement can be reached, the dispute will be settled by the Harju County Court.
